Attorney Benjamin Crump wrote a letter to Missouri Governor Jay Nixon today requesting that he reconsider appointing a special prosecutor to investigate the fatal shooting death of Michael Brown Jr. It has been 58 days since Ferguson police officer killed the unarmed teen. Crump is co-counsel for the Brown family along with local attorney Anthony Gray.

“Respectfully, the decision you announced on August 19, 2014, does not address the compelling and rising concerns of conflict that now exist between Robert (Bob) McCulloch, the St. Louis County Prosecutor and the Ferguson Police Department,” Crump stated in the letter.

McCulloch has refused to recuse himself. McCulloch told The St. Louis American that Nixon could have legally removed him from the case after issuing a state of emergency, but the governor failed to do so.

Crump cited conflict of interest and bias in his letter. He said the recent decision by the St. Louis Prosecuting Office to place all cases involving Officer Wilson on hold presented issues of concern.

“Officer Wilson, as the arresting officer and primary witness for many of the prosecution’s current cases, has developed a special working relationship with McCulloch and his office,” Crump said. “As a potential defendant who would be prosecuted by the same office if indicted, Wilson would impact the administration of justice.”

Gray said Sunday at a press conference that they continue to seek a fair and transparent process and have again called for Wilson’s immediate arrest. On October 10, a Justice Now March will take place from 3:00 – 5:00 p.m. at the Buzz Westfall Justice Center in Clayton. The march on McCulloch’s office to is to demand justice for Brown and kicks off a weekend of resistance that will continue through October 13.
